 NJ League of Municipalities Challenges COAH

Attorney Ed Buzak, in his capacity as Assistant Counsel to the NJ League of Municipalities, provided this Executive Summary of the League's challenge to the Third Round Regulations adopted by COAH effective June 2, 2008 and as revised to October 20, 2008.

Residential versus Non-Residential Growth

 

Prepared by Bill Denzler, Denville's Planning Consultant, this spreadsheet dated May 2008 shows Denville's non-residential development in terms of square footage and residential development in terms of housing units. No breakout is provided for first or second round COAH housing units or the associated market value units required by COAH. Non-residential development impact on third round COAH obligations is shown in the table "Non-Residential Growth, 01/2004 to present".

Denville's Planner Provides Narrative

 

Denville's Planning Consultant, Bill Denzler, provided Mayor Hussa with a COAH Narrative on February 9, 2009. This document explains COAH requirements, COAH's recent rule changes to determine a municipality's "obligation", court challenges to that, and more.
